Refund and Cancellation Policy

1. Relationship to Terms and Conditions

This Refund and Cancellation Policy forms an integral part of, and must be read in conjunction with, our Terms and Conditions of Service and Simulation (v3.2). In the event of any conflict or inconsistency between this Refund Policy and the Terms and Conditions, the Terms and Conditions shall prevail as the authoritative legal document.

2. Statutory Right of Withdrawal & EU Cooling-Off Period

2.1. 14-Day Statutory Right: Pursuant to applicable consumer rights legislation (including EU Consumer Rights Directive 2011/83/EU and UK Consumer Contracts Regulations), consumers residing in the European Union, European Economic Area, or United Kingdom hold a statutory right to cancel their purchase within 14 calendar days from the transaction date without providing a reason.

2.2. Immediate Service Commencement & Explicit Waiver: By purchasing an Evaluation Package on https://fundly.games/ and actively checking the consent box at checkout via Whop Inc. ("WHOP"), you explicitly request and consent to the immediate performance of the digital contract and provision of access to the simulation software before the expiration of the 14-day statutory cooling-off period.

2.3. Loss of Cancellation Right: Pursuant to Article 16(m) of EU Directive 2011/83/EU, you explicitly acknowledge and agree that your 14-day statutory right of cancellation is fully waived and forfeited the moment digital service performance begins, defined as:

• Logging into the simulation dashboard; or
• Submitting the first simulated analytical entry on the account.

3. Eligibility for Full Refund (Unused Accounts)

3.1. A Customer is eligible for a full 100% refund of the evaluation package fee within 14 calendar days of purchase ONLY IF all of the following conditions are met:

• The Customer has NOT logged into the simulation dashboard; AND
• ZERO simulated entries or predictions have been placed on the account.

3.2. Once an account has been accessed and the first simulated entry has been placed, the digital service is deemed fully rendered, and the evaluation fee becomes strictly non-refundable.

4. Breached Accounts & Evaluation Fails

4.1. Rule Violations: Evaluation Packages are performance-based software assessment modules. An account is classified as breached and immediately terminated if any of the following parameters are violated:

• Exceeding the Maximum Daily Loss limit (-4% of capital);
• Exceeding the Maximum Total Drawdown limit (-10% static in Phases 1 & 2; -10% trailing in Phase 3);
• Submitting simulated entries outside the permissible odds range (coefficients 1.00 to 8.00); or
• Exceeding the maximum risk limit per single entry (1.5% of account capital).

4.2. No Refunds for Breached Accounts: Breaching any challenge parameter results in automated account deactivation. Breached accounts lose all evaluation progress, and evaluation fees remain 100% non-refundable.

4.3. Discounted Reset Option: If an account is breached or fails an evaluation phase, the Customer does not incur any debt or financial liability beyond the initial evaluation fee. Customers may purchase a new Evaluation Package at any time or restart their evaluation at a discounted reset fee of 40% of the standard package price.

5. Discretionary Refunds & Right of Refusal

5.1. The Company reserves the right, at its sole discretion, to decline service, suspend accounts, or decline entering into an Independent Contractor Agreement (Phase 3 Partner Phase) with any individual, with or without prior notice.

5.2. If the Company terminates an unbreached user account under its discretionary right of refusal without cause, any uninitiated or unused evaluation package fee may be refunded at the Company's sole discretion.

6. Anti-Chargeback Policy & Dispute Enforcement

6.1. Dispute Resolution Requirement: If you experience billing issues or technical errors, you agree to contact our support team at support@fundly.games prior to opening a dispute with payment processors or financial institutions.

6.2. Unwarranted Chargebacks: Initiating an unauthorized or fraudulent chargeback via credit card issuers, banks, or payment gateways (including WHOP) after accessing the simulation dashboard or breaching account parameters constitutes a material breach of our Terms and Conditions.

6.3. Penalties: In the event of an unwarranted chargeback, the Company reserves the right to:

• Permanently blacklist the user across all affiliated networks;
• Revoke all pending contractor performance rewards; and
• Charge an administrative fee of $250 USD plus legal processing costs incurred to recover the disputed funds, where permitted by applicable law.

7. How to Request an Eligible Refund

To request a refund for an unused account under Section 3, please submit a written request within 14 calendar days of purchase to support@fundly.games including:

• Your registered full name and email address used on WHOP / Fundly Games;
• Order transaction ID / Receipt number; and
• A statement confirming that you have not logged into the simulation dashboard or submitted any simulated entries.

All verified refund requests are processed back to the original payment method within 5 to 10 business days.
